The popularity of mediation as a means of ADR has grown significantly over the last few decades. This is partly because mediation is quick and generally more cost-effective compared to other existing forms of dispute resolution methods such as litigation and arbitration. In mediation, the parties are encouraged to think openly and creatively, to get to the root of the problems and to explore a wide range of possible solutions. The flexibility in the remedies offered allows the parties to go beyond purely legal arguments and solutions afforded in court, and towards the possibility of cognitive and emotional resolution.
Success in mediation will depend upon a multitude of factors, including the attributes of a mediator and his/her skills in controlling the process. In this seminar, the speaker will discuss the critical success factors as well as the roles of the mediator, parties, lawyer and expert in an effective mediation. The speaker will also discuss some obstacles to successful mediation and provide some practical tips on how to avoid them as well as some do’s and dont’s in mediation.
